A propos of our discussion about governance/jurisdiction on the Net of last week in Cyberlaw and the Global Economy, here’s another case study from the Baker and McKenzie web site, via ever-vigilant teaching fellow Urs Gasser.  The gist of the story is that an Italian web site is ordered by a court in Amsterdam to make its site inaccessible to Dutch residents, reminiscent of the French court ruling in the Yahoo! France Nazi paraphrenalia case.  Note that the decision appears to have relied upon the technical feasibility of zoning the Net.  Is a slew of these decisions inevitable, especially as geolocation techniques improve?
