Eldred goes to Latin America

Brazilian lawyers are talking about Eldred.

And: anyone thought through the copyright implications of aggregators?  If the content is not expressly licensed in such a way as to permit copying or contributed to the public domain, (e.g., via a Creative Commons license), then is there a problem with the repeated copying of the content?  Maybe there’s some kind of an implied license (how much help is that?).  Maybe the clipping is always partial and one could mount a fair use defense (don’t count on it).  Maybe blogging itself just rests at the margins of copyright infringement and we have to learn to live with that.  (Until the copyright enforcers show up with fancy lawyers).
